KOSHERVITAMINS.COM — TERMS OF USE
Effective date: October 19, 2026
1. ACCEPTANCE AND SCOPE
Welcome to KosherVitamins.com (the “Site”), operated by Kosher Vitamins & Nutrition, Inc. (“Company,” “we,” “us,” or “our”). These Terms govern your use of the Site and related services, including purchases and participation in our text messaging program. Please read them before using the Site. Where an affirmative agreement is required, we will request it separately. If you do not agree to these Terms, do not use the Site.
Purchases, account registration, and enrollment in our text messaging program are intended for individuals who are at least 18 and have the legal capacity to agree to these Terms. If acting for an organization, you represent that you have authority to bind it. Mandatory consumer rights under applicable law remain in effect.
2. YOUR LICENSE TO ACCESS THE SITE
The Site’s content, information, software, designs, trademarks, images, and data (“Content”) are protected by intellectual property and other laws. Subject to these Terms, we grant you a limited, nonexclusive, nontransferable, revocable license to access and use the Site for personal, noncommercial purposes and authorized purchases. You may download or print Content for those purposes if you retain copyright and proprietary notices. All other rights are reserved.
Except as permitted by law or our prior written approval, you may not:
* Reproduce, modify, distribute, sell, license, broadcast, or create derivative works from the Site or Content outside this license. * Reverse engineer Site software or bypass security, authentication, or access controls. * Damage or disrupt the Site, introduce malicious code, or obtain information not intentionally made available to you. * Scrape, harvest, or collect Content or personal information through unauthorized automated means. Bona fide search engines may index public pages subject to applicable access restrictions. * Frame the Site, misuse our marks, impersonate another person, or falsely imply an affiliation or endorsement. * Use the Site for fraud, unlawful activity, or unauthorized health or disease claims about our products.
We may suspend or terminate access for violations of these Terms, security concerns, legal requirements, or discontinuation of a service. We will provide notice where required by law. Termination does not eliminate obligations concerning accepted orders, refunds, or other accrued consumer rights.
3. ACCOUNTS AND SECURITY
Certain features require registration. Provide accurate, current, complete information and update it when needed. Protect your credentials, do not share them, and notify us promptly at [email protected] if you suspect unauthorized access or a security incident. You are responsible for activity you authorize through your account. Nothing in these Terms makes you responsible for unauthorized transactions beyond applicable law or limits payment-card and other statutory protections.
4. HEALTH INFORMATION AND DIETARY SUPPLEMENTS
The Site provides general information and does not provide medical advice, diagnosis, or treatment. Site content, customer support communications, and user submissions do not create a healthcare-provider relationship or replace professional advice. Do not use them to diagnose or treat a health condition or to replace prescribed medication or treatment.
Consult a qualified healthcare professional before using supplements, particularly if pregnant, nursing, taking medication, preparing for surgery, or managing a medical condition. Follow product labels and warnings. Ingredients and formulations may change; check the actual product label before use and contact us about material discrepancies.
Statements about dietary supplements’ effects on the structure or function of the body have not been evaluated by the Food and Drug Administration. Dietary supplements sold through the Site are not intended to diagnose, treat, cure, or prevent any disease. These disclaimers do not excuse inaccurate advertising or replace required product-specific labeling or claim substantiation.
Kosher status and certifications are specific to the product and may change. Review the product’s current certification and packaging and contact us with questions before purchasing.
5. PRIVACY
Our Privacy Policy, available through the Site’s “Privacy Policy” link, explains how we collect, use, disclose, and retain personal information and how to exercise applicable privacy rights. Review it before providing information. Use of the Site does not, by itself, constitute consent to marketing messages, sensitive-data processing, or any other activity requiring separate consent. We will obtain consent where legally required. Nothing in these Terms waives applicable privacy rights.
6. MOBILE TERMS OF SERVICE
Program description. By opting into KosherVitamins.com text messaging, you agree to receive recurring automated marketing, promotional, and customer care messages from Kosher Vitamins & Nutrition, Inc. at the phone number provided, consistent with your consent. Messages may include offers, product promotions, order updates, and responses to support requests. Marketing enrollment requires your separate affirmative consent; purchasing, creating an account, or accepting these Terms alone does not enroll you.
- Where required by law, we obtain prior express written consent before sending automated marketing texts. Consent to receive marketing text messages is not a condition of purchasing any goods or services. You confirm that you are the subscriber or customary user of the number provided and are authorized to consent to messages at that number. Notify us if you change or relinquish that number. Your consent applies to our program and does not authorize unrelated businesses to market to you.
Message and data rates. Message and data rates may apply depending on your mobile carrier plan. You are responsible for charges imposed by your carrier.
Message frequency. Message frequency varies depending on account activity and promotional schedules.
Opt-out instructions. You may opt out of receiving text messages at any time by texting STOP to 929-383-7705 or replying STOP to a message from our program. After texting STOP, you will receive one final confirmation text confirming your unsubscribe request. That confirmation will not contain marketing. We will honor clear opt-out requests, including requests using QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE, and requests submitted through the support contacts below. We will process requests as soon as reasonably practicable and within any shorter deadline required by applicable law; in no event will processing exceed ten business days where that federal deadline applies. We will not require a purchase, fee, account login, or explanation to opt out. We will not send further program messages after processing your opt-out unless you newly opt in or a message is otherwise legally permitted. Unsubscribing does not cancel an order or remove your ability to contact customer service through other channels.
Help and support. For assistance, text HELP to 929-383-7705, reply HELP to a program message, or email [email protected]. You may also call customer service at 718-686-6112.
Carriers and availability. Carriers are not liable for delayed or undelivered messages. Service depends on supported carriers, devices, and network availability. Delivery is not guaranteed. This limitation applies only to the extent permitted by law.
Mobile privacy. Our Privacy Policy applies to information collected through the program. We do not sell or share mobile opt-in information or text messaging consent with third parties or affiliates for their own marketing or promotional purposes. We may disclose information to service providers solely as needed to operate and support our program, subject to appropriate restrictions, or as required by law. This does not authorize those providers to use your consent for their own marketing.
Program changes. We may change or discontinue the program with notice where required. Material changes to the sender, purpose, or scope of your consent require new consent where applicable. Posting revised Terms alone does not expand your marketing consent. This program is not an emergency service.
7. USER SUBMISSIONS, REVIEWS, AND SOCIAL MEDIA
The Site and Company-operated social media pages may permit reviews, comments, images, or other submissions (“User Submissions”). You retain ownership of your submissions. By submitting content intended for public display, you grant us a nonexclusive, worldwide, royalty-free license to host, reproduce, display, distribute, and format it as reasonably necessary to operate the Site and display customer feedback. We may permit service providers to exercise these rights on our behalf for those purposes. This license does not transfer ownership or independently authorize use of your likeness in an advertising campaign. Additional permissions will be obtained where required.
This public-content license does not apply to private support communications or account, payment, or health information. We handle personal information under our Privacy Policy. Do not post confidential, financial, or sensitive health information in public submissions.
You represent that you have the rights needed to submit content and that it reflects your actual experience where presented as a review. Do not submit unlawful, infringing, fraudulent, defamatory, threatening, harassing, obscene, or malicious content, another person’s private information, spam, or undisclosed paid endorsements. Disclose material relationships or incentives where required. Reviews must not present unsupported product claims as established medical facts.
You may share honest positive or negative opinions about our products, services, and conduct. Nothing in these Terms prohibits lawful reviews, imposes penalties for them, or requires transfer of ownership in them. We do not remove or suppress reviews solely because they are negative. We may moderate submissions on lawful, consistently applied grounds, including fraud, irrelevant content, threats, privacy violations, and infringement, and will not misrepresent which reviews are displayed. Any incentives we offer for reviews will not be conditioned on a particular sentiment.
We do not endorse user statements or guarantee that all submissions will be reviewed. We remain responsible for our own conduct as required by law. Third-party social media platform rules also apply to use of those platforms.
8. THIRD-PARTY LINKS AND SERVICES
Links to third-party websites and services are provided for convenience. Unless expressly stated, they do not constitute endorsement. Third-party services have their own terms and privacy practices; review them before use. We are not responsible for independent third-party content or conduct except as applicable law provides.
9. ORDERS, PAYMENT, AND PRODUCT INFORMATION
Use a payment method you are authorized to use and provide accurate billing and delivery details. By placing an order, you authorize payment of the disclosed price, taxes, shipping, and other charges shown before completion. The currency and applicable charges will be identified at checkout.
An order acknowledgment confirms receipt and does not necessarily constitute acceptance. We may decline or cancel an order for legitimate reasons such as unavailability, suspected fraud, legal restrictions, or a material pricing error. If payment was collected for an order we cancel, we will issue the required refund promptly. We will obtain your agreement before charging a higher corrected price; you may instead cancel the affected item for a refund.
We aim to provide accurate descriptions, prices, availability, and images. Errors may occur, but this does not limit our responsibility for misleading representations or goods that fail to meet applicable legal requirements. Contact us promptly about incorrect, defective, damaged, or materially misdescribed goods. Your remedies include those required by law and are not limited to returning an unopened product when the law provides otherwise.
10. SHIPPING, RETURNS, AND REFUNDS
Review the shipping and return policies linked on the Site and disclosed at checkout before ordering. Those policies supply transaction-specific details, including eligible return periods, authorization requirements, product-condition requirements, and disclosed shipping or restocking charges. The policy disclosed for your purchase applies, subject to mandatory law. Later policy changes do not retroactively reduce your rights.
We will ship within the stated time or, if no time is stated, within the period required by applicable law. For covered U.S. orders, that is generally 30 days after receipt of a properly completed order. If we cannot ship as required, we will provide the required delay notice and cancellation/refund option and obtain consent to delay where required. We will cancel and refund unshipped merchandise where consent is not obtained as required.
Voluntary return restrictions do not eliminate rights concerning defective goods, misdescription, shipping failures, payment disputes, recalls, or other legally required remedies. No “all sales final” statement overrides those rights.
11. CALIFORNIA PROPOSITION 65
Certain products may expose users to chemicals identified by the State of California as causing cancer, birth defects, or other reproductive harm. Where a warning is required, consult the applicable product-specific warning displayed with the product or before purchase and any warning on its packaging. For information, visit https://www.P65Warnings.ca.gov.
This general notice does not replace a required product-specific warning. Nothing in these Terms asks you to waive rights under Proposition 65 or treats completion of checkout as a waiver of a warning requirement.
12. INTERNATIONAL ORDERS
For shipments outside the United States, review destination restrictions, shipping charges, and import conditions before ordering. Unless checkout states otherwise, prices do not include destination customs duties, import taxes, or customs clearance fees, and you are responsible for lawful charges payable by the importer. Where legally applicable, you act as importer of record and must comply with destination import requirements. We remain responsible for export and other obligations imposed on us by law.
If a shipment is refused, undeliverable because of an incorrect address you supplied, or rejected due to a restriction you were responsible for checking, we may deduct reasonable, documented, legally recoverable shipping, return, and customs costs from a refund, subject to disclosures made before purchase and applicable law. We will communicate available options if lawful return or delivery is impossible. We will not impose blanket forfeiture or abandonment charges where prohibited. Charges resulting from our error remain our responsibility to the extent required by law.
Nothing in these Terms excludes mandatory consumer protections that apply to an international purchase, including any applicable cancellation or refund rights.
13. COPYRIGHT COMPLAINTS
If you believe material on the Site infringes your copyright, send a notice to the Legal Department using the contact details in Section 20. Include:
- Your physical or electronic signature, or that of an authorized representative.
- Identification of the copyrighted work, or a representative list for multiple works.
- Identification and location of the allegedly infringing material sufficient for us to locate it.
- Your address, telephone number, and email address.
- A statement that you believe in good faith that the use is not authorized by the owner, its agent, or the law.
- A statement that the notice is accurate and, under penalty of perjury, that you are authorized to act for the owner of the allegedly infringed exclusive right.
We will address qualifying notices and counter-notices as required by applicable law. We may remove or disable access to material and, in appropriate circumstances, terminate repeat infringers. Knowingly material misrepresentations in infringement notices or counter-notices can create liability under applicable law.
14. DISCLAIMERS
TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND GENERAL INFORMATION ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DO NOT GUARANTEE UNINTERRUPTED ACCESS, ERROR-FREE OPERATION, OR THE ABSENCE OF HARMFUL CODE. TO THAT SAME EXTENT, WE DISCLAIM IMPLIED WARRANTIES RELATING TO THE SITE, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
These disclaimers do not exclude express product warranties, applicable statutory warranties, responsibility for unlawful or deceptive conduct, or other rights that cannot lawfully be excluded. Product warranties and remedies remain subject to applicable law and any valid product-specific terms disclosed before purchase.
15. LIMITATION OF LIABILITY
TO THE EXTENT PERMITTED BY LAW, WE AND OUR SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE SITE.
For claims concerning Site access or operation alone, our aggregate liability is limited, to the extent permitted by law, to amounts you paid us during the three months preceding the event giving rise to the claim. Neither the damages exclusion nor the liability cap in this section restricts refunds or remedies concerning purchased goods, personal injury, product liability, fraud, willful misconduct, gross negligence, or any liability or rights that cannot lawfully be excluded or limited. No limitation protects a person from liability that applicable law does not permit that person to exclude or limit. Some jurisdictions do not permit certain exclusions or limitations, so they may not apply to you.
16. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify the Company against third-party claims and reasonable resulting costs to the extent caused by your unlawful use of the Site, infringement of another person’s rights, or material breach of these Terms. This does not require you to indemnify us for our own negligence, unlawful conduct, or breach of these Terms, or merely for making a lawful complaint or review. We will provide reasonable notice and an opportunity to participate in the defense. No settlement may impose an admission or nonmonetary obligation on you without your consent.
17. GOVERNING LAW AND COURTS
New York law governs these Terms, except where applicable federal law or mandatory consumer protections require otherwise. Subject to your nonwaivable rights, disputes may be brought in the state courts located in Kings County, New York, or the federal court with jurisdiction over that location, and the parties consent to those courts’ jurisdiction. This provision does not prevent proceedings in another court where applicable law gives you that right, including an eligible small-claims court. Applicable statutory limitation periods apply. These Terms do not impose mandatory arbitration or a class-action waiver.
18. CHANGES TO THESE TERMS
We may update these Terms prospectively by posting a revised version and effective date. We will give reasonable notice of material changes, including by email or a prominent Site notice where appropriate, and obtain affirmative agreement where required. Changes do not retroactively alter completed purchases or accrued disputes. Separate marketing consent cannot be expanded through a Terms update alone. Continued use after the effective date constitutes acceptance only to the extent permitted by applicable law.
19. GENERAL TERMS
These Terms and transaction-specific terms disclosed and validly agreed to at purchase govern their respective subject matter. Our Privacy Policy describes personal-information practices and does not eliminate separate consent requirements. If a provision is unenforceable, the remaining provisions remain effective to the extent permitted by law; a court may limit the invalid provision only as legally permitted. Failure to enforce a provision is not a waiver. No provision limits your right to contact regulators, report unlawful conduct, or exercise nonwaivable rights.
